台灣那美好國家

中華憲法代表哪國

過去常聽老一輩台灣人,告誡子女出門在外,凡事小心,總一再叮嚀,要謹慎、提防小人,作事要瞻前顧後,工作進行得看頭看尾,才不會出大錯。中國病毒武漢肺炎來襲時,台灣的穩健防疫超前部署,使台灣成為國際社會稱讚,有效防疫成功的典範,是全球公認世界上最安全美好的國家,他們都稱台灣是一個國家,讓海內外台灣人都與有榮焉。但五二0觀看了蔡英文總統就職典禮,卻令人百感交集、欲哭無淚。當下是台灣人民自主意識,最為高昂的時刻,幾百年來難得的輝煌局面,卻居然還要向中國威權磕頭屈服,台灣民選總統,竟然是向孫行者遺像宣誓,而且還要效忠那一本不知,代表什麼國家的憲法。您說,這怎不叫人無語問蒼天、錐心泣血呢?

中華民國第15任總統暨副總統就職典禮,於五二0在總統府舉行,蔡英文及賴清德分別一一在孫中山遺像前,高舉右手朗誦「余謹以至誠,向全國人民宣誓,余必遵守憲法,盡忠職務,增進人民福利,保衛國家,無負國民付託。如違誓言,願受國家嚴厲之制裁。」完成宣誓。隨後移師台北賓館,發表就職演講。

蔡英文說:『這是中華民國史上,最特別的總統就職典禮。過去七十年來,中華民國台灣,在一次又一次的挑戰中,越發堅韌團結。我們抵抗過侵略併吞的壓力、走出獨裁體制的幽谷,也一度走在被世界孤立的曠野之中,但無論什麼樣的挑戰,民主自由的價值,一直是我們的堅持。「自助助人、自助人助」的共同體意識,也始終是我們的信念。我們兩千三百萬人,是生死與共的命運共同體。過去是這樣、現在是這樣,未來也是這樣。台灣的故事,屬於每一個人,也需要每一個人。兩千三百萬的台灣人民,請當我們的導引,請當我們的夥伴,讓我們凝聚智慧與勇氣,一起打造一個更好的國家。』

中華人民共和國與台灣無瓜葛

既然蔡總統公告台灣的未來,有賴於每一位台灣人集思廣益,那麼我也藉此筆上論政,來談談台灣的故事。扛著14億中國人不認同的中華民國憲法,向兩千三百萬台灣人民及孫中山遺像宣誓,就任台灣人、民選總統職務,這是那一門的政治科學,真讓人有點時空錯亂。因為孫先生於1925年3月12日過逝,至今已超過95年了,再說他與過去七十年的中華民國毫無關聯,若硬要說有,那就是上溯指1912年創立的中華民國。但國際社會說,那個中華民國已在1949年就被中華人民共和國所取代。1949年以後的中華民國在法理上,聯合國也於1971年10月25日,正式承認中華人民共和國,才是中國唯一合法的政府代表,但它與台灣和台灣人民,卻無絲毫牽連、也沒有任何瓜葛。

走過威權不屬中華

五二0當天,有超過41個國家政要領袖傳來錄影,祝賀蔡英文就職。其中,要以美國國務卿龐培歐的祝賀最令人矚目,他直稱蔡英文博士為台灣總統、不是中華民國總統。因為她確實是台灣人民,用選票直選出來的總統,理應代表台灣,與中國或那不清不楚的中華民國無關。因為,確實沒有人知道中華民國它是要代表誰,想代表中國、門都沒有。想代表台灣,那又為什麼扯出孫中山、與中華民國憲法哪呢?難不成還在幻想,長江、黃河、蒙古和中原?

令人釋懷的是,蔡英文在典禮上已經聲明,立法院即將成立修憲委員會,提供一個平台,讓攸關政府制度、以及人民權利的各項憲政體制改革議題,能夠被充分對話、形成共識。台灣確實有世界上最聰明、最勤奮的人民,但卻長年被束縛在,全世界最荒謬的法統體制。還好,幸虧有李登輝前總統等先進前輩們的努力,總算把那萬年國代、委任選舉一一剔除。現在台灣人民享有的國會改選、總統直選、言論自由、結社自由、出版自由、社會民主,這些都是先賢前輩們,用性命、流血、流淚爭取來的,但把它與過去的威權併列,顯得格格不入、令人倒盡胃口,礙難接受。

改革務實參與國際 

台灣社會在蔡英文的調度下,成功地克服武漢肺炎,我們防疫國家團隊的表現,獲得全球世人尊敬與讚賞。我們更在行有餘力時,不忘回饋國際社會,向全球有需要的國家與人民,提供服務;台灣能幫助、台灣即時幫Taiwan Can Help, Taiwan Is Helping更是讓所有台灣人都與有榮焉。事實證明,台灣是拿得出來,可以獨當一面,走得出去,也自己能站起來,而且還能在世上發熱發光。蔡英文說:「這次疫情對全球的衝擊既深又廣,它改變了全球政治經濟的秩序,不僅加速、加大了全球供應鏈的重組,重新排列了經濟板塊,也改變了人們的生活和消費型態,甚至也改變了國際社會對台灣和周邊情勢的想像。」沒錯,危機就是轉機,只要我們時時警惕、超前部署,必能掌握時局、與時俱進。

蔡總統還說:「過去四年,我們推動國防事務改革、積極參與國際,維持兩岸關係的和平穩定,希望讓台灣在印太地區的和平、穩定與繁榮,扮演更積極的角色。未來四年,這些政策方向不會改變,我們也會做得更多。未來四年,我們會持續爭取參與國際組織,強化和友邦的共榮合作,和美、日、歐等共享價值的國家,深化夥伴關係。」想要參與國際事務的先決條件,就是定位自己。如果我們要一再地標榜那,早已不切實際的法統與憲法,一再地拿虛擬主權國度、中華民國,那我們就永遠走不出去。因為聯合國2758號決議,已將它完全交給中華人民共和國繼承了,除非歷史改寫,可能嗎?

漠視國際法理論述 台灣陷一中困境

再說,我們究竟是想要代表誰、想要爭取什麼、台灣有能力代表中國嗎、2300萬台灣人有資格代表14億中國人嗎?真是讓人莫名其妙,死抱著中華民國到底是什麼法理依據?中華民國政府拿得出,擁有台灣領土主權的國際條約、或法理文件嗎?日本政府何時依那一個和平條約,將台灣主權轉交給中華民國?要知道人民主權Popular Sovereignty,並不等同國際組織所要求的國家主權National Sovereignty,或領土主權Territorial Sovereignty。今日台灣社會所擁有、享有的是人民主權,那是群體社會的基本人權,但我們還沒真正擁有台灣的領土主權,那是須要透過合法的法理程序,才能取得。簡單地說台灣社會,還沒有組成一個真正代表台灣人民的台灣政府,不是那個既要代表中國、又要代表台灣的中華民國台灣。國際社會是不可能讓它,擁有台灣的領土主權,那有多危險,轉手間就要被中華人民共和國給繼承了。

有關中國議題,蔡英文再次重申「和平、對等、民主、對話」,她說:我們不會接受北京當局,以「一國兩制」矮化台灣,破壞台海的現狀,這是我們堅定不移的原則。說得好,台灣不是中國的一部分。但言下之意似乎在強調,要以中華民國,尋求與中華人民共和國平起平坐,展開和平、對等、民主、對話。看來蔡政府團隊的思維,完全認同台灣今日現狀,是國共內戰的殘局,而不是二次大戰後,美國在西太平洋未完的國際事務。這不但漠視國際社會的法理論述,也辜負了,世界各國對台灣國家的殷切期盼。蔡團隊對台灣國際法理論述,毫無著墨、令人遺憾。不知是不信、不認同或不以為然,但它卻是,台灣要參與國際組織必經之途。台灣真的不等同中華民國,也不是中華民國台灣,這是國際社會的認知,台灣就是台灣。演講中蔡英文總統說,要給我們留下一個更美好的國家,您認為那會是什麼樣的國家?我們有可能在四年後看到嗎?且讓我們拭目以待。

Taiwan that sound country

What country does ROC Constitution represent?

The older generation of Taiwanese advised their absent children, be cautious in everything, always be alerted, beware of villains, thoughtfully plan from beginning to the end, and work carefully to avoid serious mistakes. Fighting against COVID-19 pandemic, Taiwan’s steady deployment of plague prevention turned itself a model that the international community praised as the safest and most beautiful country in the world. They all referred Taiwan as a nation, and made worldwide Taiwanese are all proud of it. But May 20 watched the inauguration ceremony of President Tsai Ing-wen, it was a mixed feeling and made me speechless. This is the moment Taiwanese with the highest sense of self-determination but ended up with kowtowing to Sun Yat-sen’s portrait and alleging to the Constitution represented nobody. Why didn’t it make people cry without tears?

Tsai Ing-wen and William Lai were sworn in as the 15th President and VP of the ROC in front of Sun’s portrait on May 20th. They rise hands respectively and proclaim “I swear with sincere to the people, follow the Constitution, devote to duty, promote people’s welfare, protect the nation and unburden people’s trust. If I violate the oath, I will receive the severe sanction of the nation.” After swear in, they moved to Taipei Hotel and gave an inaugural speech.

Welcome to guide Taiwan stories

Tsai Ing-wen said: “This inauguration ceremony is unique in the history of the ROC. Over the past 70 years, the ROC Taiwan has grown more resilient and unified through countless challenges. We have resisted the pressure of aggression and annexation. We have made the transition from authoritarianism to democracy. Although we were once isolated in the world, we have always persisted in the values of democracy and freedom, no matter the challenges ahead of us. We will always remain committed to our common belief: Taiwan must help ourselves to help others, and when we help ourselves, others will help us. We, the 23 million people, have always been and will always be a community with a shared destiny. I ask that the 23 million people of Taiwan act as our guides and partners. Let us pool our wisdom and courage and make this country a better place together.”

PRC has nothing relates to Taiwan

Since President Tsai’s public call brainstorm for the future of Taiwan relies on every Taiwanese, so let me also share my view of point to talk about Taiwan story. Carrying the ROC Constitution, which 1.4 billion Chinese do not agree with, swore to the 23 million Taiwan people and the portrait of SYS to take up the post of presidential installation elected by Taiwan voters, what kind of logic science that really makes people a bit confused in time and space. Because Mr. Sun died on March 12, 1925, it has been more than 95 years now. Besides, he has nothing to do with the ROC in the past 70 years. If it is necessary to say that there is, it refers to the ROC founded in 1912. But the international community said that ROC had been replaced by the PRC in 1949. Legally, the ROC after 1949, the UN recognized it had officially succeeded by PRC under Resolution 2758 passed on October 25, 1971, authorized it as the only legal government of China, but it has nothing to do with Taiwan and Taiwan people.

Ruled by authoritarian but is not of China

There were more than 41 national leaders delivered message to congratulate President Tsai Ing-wen on taking office. Among them, the one from US Secretary of State Michael Pompeo is the most remarkable. He tweet “Congratulations to Dr. Tsai Ing-wen on the commencement of your second-term as Taiwan’s President. Taiwan’s vibrant democracy is an inspiration to the region and the world. With President Tsai at the helm, our partnership with Taiwan will continue to flourish.” Yes, she was directly elected by Taiwan people shall be the President of Taiwan not ROC, for not clear in representative. None really know it represents China or Taiwan? Represent China, no way. If it represents Taiwan, then why mentioned Sun? Still missing the Yangtze River, Yellow River, Mongolia and Central Plains? It is nothing but fantasy.

What reassuring is that President Tsai announced at the ceremony that the Legislative Yuan is about to establish a constitutional amendment committee to provide a platform for various constitutional reform issues concerning the government system and people’s rights to be fully discussed and reached consensus. Taiwan does have the smartest and most diligent people in the world, but it has been bound by the most absurd legal system in the world for many years. Fortunately, thanks to the efforts of former President Lee Teng-hui and other pioneers, the life-long national assemblymen and commissioned elections were finally eliminated. The re-election of Congress, direct election of the President, freedom of speech, freedom of association, freedom of publication, and social democracy enjoyed by Taiwan people today are due to predecessors’ efforts sacrificed their lives, blood, and tears, but juxtaposing it with past authority, it's out of place, unpleasant, and difficult to accept.

Reform pragmatically then participate in international

Thanks to Tsai’s operation successfully overcome the COID-19 pandemic, her national team of virus prevention earned worldwide applauds and respects. When we are in safe condition, not hesitate to extend help to those countries and people who need indeed around the world; Taiwan can help and Taiwan is helping. It provides the worldwide Taiwanese with a sense of pride. It proves Taiwan can stand well alone and shinning in the world. Tsai said: “The pandemic has profoundly affected our world. It has changed the global political and economic order, accelerated and expanded the reorganization of global supply chains, restructured the global economy, and changed the way we live and shop. It has even changed the way the international community views Taiwan and developments in the surrounding region.” Yes, the crisis is always coming with opportunity, as long as we are vigilant and plan ahead, we will be able to grasp the current situation and keep pace with the times.

President Tsai also said: “Over the past four years, we have pushed for national defense reforms, active international participation, and peaceful, stable cross-strait relations. We hope that Taiwan can play a more active role in the peace, stability, and prosperity of the Indo-Pacific region. In the next four years, the direction of our policies will remain the same, and we will do even more. We will continue to fight for our participation in international organizations, strengthen mutually beneficial cooperation with our allies, and bolster ties with the US, Japan Europe, and other like-minded countries.” The first step to participate in international affairs is to identify oneself. If we always tie with the long-standing unrealistic laws and constitutions, and repeatedly take virtual sovereignty and the ROC, then we will never get there. Because UN Resolution 2758 has been completely handed it over to PRC for succession, unless history is rewritten, is it possible?

Legal Theory on National Sovereignty

Besides, who exactly do we want to represent, what do we want to fight for, is Taiwan capable of representing China, and are 23 million Taiwanese eligible to represent 1.4 billion Chinese? It is really inexplicable, what is the legal basis of the ROC? Can it come up with any international treaty or legal document that holds Taiwan’s territorial sovereignty? When does the Japanese government transfer Taiwan sovereignty to ROC in accordance with that peace treaty? It is important to know that Popular Sovereignty is not equivalent to National Sovereignty or Territorial Sovereignty required by international organizations. What Taiwan society possesses and enjoys today is the popular sovereignty, which is the basic human right of the group entity, but we have not really possessed Taiwan’s territorial sovereignty, which requires legal procedures to obtain it. Simply speaking, Taiwanese society has not yet formed a Taiwanese government that truly represents the people of Taiwan. It is not the ROC that represents both China and Taiwan. It is impossible for the international community to let it have Taiwan’s territorial sovereignty. How dangerous it is will be inherited by the PRCC.

We will not accept the Beijing authorities to use "one country, two systems" to dwarf Taiwan and undermine the status quo in the Taiwan Strait. This is our unswerving principle. Yes, get the point, Taiwan is not part of China. But the implication seems to emphasize that the ROC should seek equal standing with the PRC to develop peace, parity, democracy and dialogue. It seems that Tsai government team fully agrees with the status quo of Taiwan today, is the endgame of the China Civil war, not the American unfinished business in the West Pacific after WWII. This not only disregarded the legal theory of the international community, but also disappointed their eager expectation of Taiwan State. Tsai government hasn’t touched the legal theory of Taiwan at all, which is regrettable. I do not know if it is unbelief, disapproval, or disapproval, but it is the only way for Taiwan to participate in international organizations. Taiwan is really not ROC nor ROC Taiwan. Taiwan is Taiwan. However, President Tsai mentioned in the speech she will leave us with a better country, what kind of country do you think it will be? Is it possible that we will see it in four years? And let us wait and see.
